This privacy policy explains how Files.fm SIA processes the information it receives when you use the Failiem.lv/Files.fm website, apps and services, as well as how you can manage or delete this information. Your data and uploaded content remain with you. We do not sell personal data or transfer it to third parties for their independent marketing use. To provide the service for specific functions, external processors and partners may be used, which receive only the information necessary for the function. You can set access to files and folders as private or available to anyone who has the relevant link. In your account settings, you can choose whether new files are private or available by link by default, and you can also change access to all your files to private.

Data is protected in accordance with the applicable laws and regulations of the Republic of Latvia and the European Union. The platform does not specifically request sensitive personal data, but it may end up in user uploaded content. The user is responsible for the legal use of such content.

The purpose of user data processing is to provide platform functions at the user’s request, including storage, receipt, purchase or content publication of photo, video, audio and text files via a link, account and payment service, security and system improvement.   1. The platform stores and processes account data, files and other information provided by the user, linking them to the person to whom they belong, if necessary. The system records the actions performed with the files and the service to the extent necessary for the operation of the service, security, support and described functions. We inform about significant changes to the platform, account and service to the e-mail address specified in the account.

To control access to user files, the platform uses unique user identifiers such as username, email, session ID and cookies to authenticate and authorize users and devices and provide service features. Information about the web browser used, the links visited, the operating system and the IP address may be stored in IT system logs for a certain period of time in order to monitor the operation of servers and software, prevent errors and investigate security incidents.

  3. The Platform may request and store non-sensitive personal data that helps verify your identity and determine who owns files, such as name, address, date of birth, preferred language, phone number and email address. This information may also be needed to restore access, for example, if a previously used e-mail address no longer works. If you authenticate with a social network account, with your permission the platform may receive basic profile information such as first name, last name and unique identifier.

  4. The platform does not specifically request sensitive personal data and does not record all user activities without a valid reason or the user’s own request. However, such data may appear in the content uploaded by the user, and the user is responsible for its legal use. Anonymized or aggregated web analytics about visits, countries and opened links may be used for service improvement and security.

  5. Users of the platform, including parents, photographers and schools, may also store information about children. The platform does not specifically request such data. If you have information about illegal use of data or content, contact us immediately via the contact form or support email; reporting option is available for each file.

  6. The system may store user-specified geographic location or other location-related information if necessary for a specific feature selected by the user.

  7. You can sign in to your account to see the information you have provided about yourself and to edit or delete it. In your account settings, you can delete your account files or your entire user account. Before the account and its data can be deleted completely, the system must verify your request. This is an automated process that you must complete yourself, using the same method used to create the account.

  8. Different types of data are stored on the platform for different periods of time: as long as specified by the user, provided by the description of the product or service, or as long as necessary for the provision of the service, accounting, auditing, security logs and the fulfillment of legal obligations.

  9. The platform does not sell personal data or transfer it to third parties for their independent marketing use. For the provision of the service and certain functions, data may be processed by the named external service providers and partners, who receive only the information necessary for the specific function.

  10. Free users may see ads. Advertising systems, including Google AdSense, Google AdX, and DoubleClick, may use cookies, technical identifiers, and anonymous device or browser data to serve, measure, and customize ads here or on other websites. Such processing is not a sale of personal data by the Platform; Advertisers’ own privacy conditions and opt-outs should be evaluated separately.

  11. Your usage, technical and location data may be associated with the specific device from which you use the Platform. Such information is not always directly linked to your identity, but technical identifiers may in some cases become personal data.

The web analytics tools we use, such as Google Analytics and, in production, Matomo, may process technical or aggregate data, including IP address, web browser name, device identifier and usage events, to understand the usability, performance and errors of the Platform. The providers of these services have their own privacy conditions.

  15. The Platform takes reasonable technical and organizational security measures to protect your data and secure access. We encrypt data transmission channels, but no security or encryption method can protect against all human error, device damage, or cyber-attacks.

  16. The information we receive or collect may be stored on servers in the countries where we or our service providers operate or where the user uses the service. Data is processed in compliance with applicable European Union data protection requirements and international transfer requirements, where applicable.

  17. To provide the Service, we may make identifiable or anonymous information available to third parties only under limited circumstances: (1) with your express consent, (2) if we have a good faith belief that applicable jurisdiction or law requires it, (3) if necessary to protect our rights or property, or (4) in the event of a merger, acquisition, reorganization, liquidation or sale of assets to a successor or purchaser. Who accesses this data?

You and the users you’ve given access to your files. In certain cases, data may also be accessed by Files.fm employees or our processors if necessary for your request, customer support, system maintenance, security, payment, authorization or other selected function.

When using the platform or visiting this website, you must comply with the Failiem.lv/Files.fm Terms of Use and this privacy policy. If you do not agree to the Terms of Use, the privacy policy or the use of cookies, you are invited not to use the platform. Data access and management?

In your account settings, you can view, edit or delete your personal data and your account. You can manage your files in My Files and in other platform apps. If you need information that is not available through the self-service tools, write to support@failiem.lv. You can set access to files and folders as private or available to anyone who has the relevant link. In your account settings, you can choose whether new files are private or available by link by default, and you can also change access to all your files to private.

Data transfer options?

You can download your data from your account and transfer it to your computer or another service. For large files, this can be facilitated by our Sync app or other cross-platform export tools, if available for the specific account.

Deleting your account data and files?

You can manually delete the account files and then the account. We do not log into your account or delete accounts for you without proper verification. The request must be technically related to the account owner; if you don’t remember your password, use password recovery. In case of confusion, write to support@failiem.lv and identify yourself.

Deleting other content that you don't have self-service access to?

If you want to delete another user’s content or data for which you do not have self-service access, please use the content review form. The request must state the identity of the requester, the reason for deletion and the legal basis.

Do you use user information for marketing purposes?

We do not sell or transfer your personal data to third parties for their independent marketing use. You may receive informational notices from us about the Platform; you can adjust the notifications you can opt out of in your account settings. Important notices about your account, security, service, and data cannot be completely disabled.

What are the data security measures?

We implement multiple levels of technical and organizational security measures to protect data at the physical and logical levels, including data centers, access controls, encryption, data arrays and logs. We have a data security policy, responsible professionals and employee confidentiality obligations.

What do we do in the event of a data breach?

We evaluate data security breaches known to us and, if required by applicable law or circumstances, notify supervisory authorities and affected users in an appropriate time and manner.

Do you store sensitive personal data?

We specifically do not request sensitive data about health, sexual orientation, religion, race or political beliefs. Such data may, however, end up in user uploaded files or other content; the user is responsible for their legal processing and may not use the platform for illegal data storage or distribution.

Where is the data stored?

Certain external service providers, transfers and the user’s browser cache may be located in another country or region; in such cases, applicable data transfer requirements should be assessed on a case-by-case basis.
